Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") defines the governing rules for using the web hosting, email, cloud infrastructure, and related technical services provided by American Digital Services, LLC.
1. Legal and Regulatory Compliance
Services may only be used for entirely lawful purposes. You agree to use our systems in strict compliance with all applicable local, state, federal, and international laws. Prohibited conduct includes, but is not limited to:
- Intellectual Property Infringement: Storing, distributing, or displaying copyrighted software, trademarks, patents, or trade secrets without explicit legal authorization.
- Data Privacy Violations: Collecting, processing, or transmitting personal data in violation of regional privacy frameworks, including but not limited to HIPAA, GDPR, and CCPA/CPRA, without implementing mandated technical safeguards.
- Child Exploitation: Hosting, caching, or streaming any materials depicting child sexual abuse material (CSAM) or promoting harm to minors.
2. System and Network Security
You are strictly prohibited from attempting to breach, probe, or compromise our infrastructure or any connected third-party network. Violations will result in immediate termination and potential criminal referral. Prohibited behaviors include:
- Malware Distribution: Hosting or facilitating ransomware, viruses, spyware, trojan horses, rootkits, or command-and-control (C2) architectures.
- DDoS and Spoofing: Participating in or launching Distributed Denial of Service (DDoS) attacks, network flooding, mail bombing, or forging IP packet headers or email envelope data.
- Unauthorized Access: Executing unauthorized scans, credential stuffing, brute-force operations, or deploying automated scrapers against systems without explicit consent.
3. Resource Abuse and Cyber-Hygiene
To preserve system stability, performance, and the commercial reputation of our platform:
- Infrastructure Abuse: Deploying unauthorized high-intensity applications that consume excessive or disproportionate CPU, memory, or storage bandwidth (e.g., cryptocurrency mining, open proxies, public Tor relays, unthrottled background scripts) is prohibited.
- Spam and Bulk Email: Sending unsolicited bulk commercial email ("Spam") through our servers, or channeling bulk spam through outside providers to point back to an environment hosted by us, is explicitly banned.
- Software Maintenance: Clients running self-managed applications (such as WordPress or custom APIs) must maintain proper cybersecurity hygiene by applying critical security patches. Unpatched environments vulnerable to active exploitation may be isolated or suspended without prior notice to protect our network fabric.
4. Enforcement and Enforcement Consequences
We are the sole arbiter of what constitutes a violation of this policy. We reserve the right to investigate potential infractions, during which access may be restricted. Violations will result in immediate suspension or termination of your services without a right to a refund, and we may pursue full civil and legal remedies.
